Legal Prohibition on Registry
FOPA (1986), 18 U.S.C. 926(a): “No system of registration of firearms, firearms owners, or firearms transactions or dispositions may be established.”
Appropriations riders (FY1979-FY2012, made permanent with “hereafter”): block ATF from requiring FFLs to submit sales reports.
NICS destruction mandate (FY2004-FY2012, made permanent): FBI must destroy approved background check records within 24 hours.
What ATF Holds
920,664,765 firearm records as of late 2021. ~865,787,086 digitized. Estimates now exceed 1 billion. Records come from Out-of-Business FFLs: when dealer closes, all Form 4473s (buyer name, address, firearm serial number) go to National Tracing Center, Martinsburg, WV.
ATF claims database “not searchable by name.” Reporting indicates name-search capability exists but is disabled.
2022 Rule Change
FFLs must retain records permanently (previously 20 years). Records that would have aged out accumulate indefinitely; when FFLs close, all go to ATF.
Senate Hearing on ATF Registry (2026)
U.S. Senate hearing called out ATF’s “approaching one billion” record database as an illegal gun registry built incrementally without explicit authorization. Gun dealers going out of business must turn over records (names, addresses, firearm purchase details) to ATF’s National Tracing Center. Biden-era policies forced dealers to retain records indefinitely, feeding a centralized, digitized collection of firearm transaction records.
ATF claims the system is “not currently searchable by name,” but the raw data for tracking exists. Erich Pratt (Gun Owners of America): called it “not a registry in name only” but “a confiscation list waiting to be used.”
Core pattern: federal agencies expand reach incrementally without explicit authorization when regulatory frameworks permit it — building a registry without calling it one.
